So long as you were not adjudicated guilty of the charge (“adjudication withheld”), you may be eligible to get the charge sealed. However, there is a list of charges that are ineligible for sealing or expungement in Florida Statutes section 943.0584. Generally, those charges are violent, sexual, drug trafficking, and terrorism-related charges.

An individual can only expunge or seal a charge once in their lifetime. If more than one charge resulted from the same arrest, you may be eligible to expunge or seal more than one charge.

If you have ever been convicted of any criminal charge or have been convicted of or had adjudication withheld on any of the charges listed under 943.0584, you will be disqualified from expunging or sealing any criminal charge.

There is no limit on how long the entire process can take. Based on previous experience, however, depending on how long the various government agencies take to respond and the county in which the expungement or sealing petition is filed, the process may take anywhere from 4 months to 1 year.
